PRIVACY POLICY

Welcome to Quickie Convenience Stores, operated by MacEwen Petroleum Inc. (collectively, “MacEwen”, “We”, “Our”, “Us”). Because We respect the right to privacy, We have developed this privacy policy (“Privacy Policy”) to demonstrate Our commitment to privacy and to inform Our customers and users of Our website located at www.quickiestores.com, our loyalty program website located at www.quickierewards.ca and any Quickie mobile application made available by Us (collectively, the “Platform”), as well as subscribers to Our email communications, (“You”, “Your”) about Our privacy practices regarding the types of information We may collect from You or that You may provide when You access or use the Platform, subscribe to Our email communications, visit Our stores, or otherwise interact with Us. 

By interacting with Us, You consent to Our collection, use, and disclosure of Your personal information in accordance with the terms of this Privacy Policy. 

1.    Definition of Personal Information 

“Personal Information” is any information that, directly or indirectly, identifies You. Personal Information includes, but is not limited to, Your name, home address, and email address. Personal Information does not include information that has been aggregated and/or anonymized such that it cannot be associated, directly or indirectly, with an identifiable individual. 

2.    Scope of this Privacy Policy 

This Privacy Policy describes the scope of Our privacy practices and explains: 

  • The type of information We collect, use, and disclose; 

  • How the information We collect is used and to whom it is disclosed; 

  • Your rights, including how to withdraw consent (where applicable) and how to opt out of certain communications; and 

  • Security procedures We have put in place to protect Your information from loss, misuse, or alteration. 

 
3.    Application

This Privacy Policy applies whenever You interact with Us, including when You access and use Our Platform, visit Our stores, and/or subscribe to Our email communications. We may require the involvement of trusted third parties to facilitate the provision of the Platform. We strive to provide the highest level of privacy possible and therefore require that any third parties offer no less protection than that offered in this Privacy Policy and as otherwise required by law to meet the data protection requirements of Canada's federal Personal Information Protection and Electronic Documents Act (PIPEDA)

4.    Links to Third Party Websites

For Your convenience, Our Platform may contain links to third party sites that are not controlled or operated by Us. We are not responsible for the content or privacy practices and policies employed by these third party sites. We encourage You to review the privacy policies of any third parties before disclosing Your Personal Information to such parties or when visiting such third party sites.

5.    Information We Collect from You

5.1 How We Collect Information from You

We collect information from You in several ways, including but not limited to when You:

  • Communicate with Us. You may disclose Personal Information to Us when You communicate with Us by email, by telephone, by visiting Our stores, through the Platform, and/or by subscribing to Our email communications. 

  • Visit or use the Platform. When You visit or use Our Platform, We may collect Personal Information about Your visit or use. This may include Your IP address, device type, device identifier or advertising identifier (or similar identifier), operating system, referring site or ad, or application, online activity on other sites or apps, and information about how You use Our Platform (such as the parts of the Platform You view, click, or otherwise interact with). If You consent, it can also include Your location (which You can disable at any time in Your device settings). 

  • Use the mobile application. When using the mobile application, We may collect Personal Information from You as described elsewhere in this Privacy Policy, including device information, application performance information, and, with Your consent, location information. 


5.2 Personal Information
 
We may collect Personal Information from You that You voluntarily submit to Us, including information that You provide when engaging with Our Platform. We do not knowingly collect, use, or disclose any Personal Information from minors under the age of 14. 

5.3 Collection of Aggregate Data

We may aggregate and anonymize data related to the use of Our Platform such that this data is not personally identifiable to any individual user, on its own or in combination with other data sets (“Aggregate Data”). We may use Aggregate Data to improve the Platform or provide other products and services, create derivative or new products, develop analytics, or for other research purposes. 

6.    Purposes for Which We Collect and Use Your Information 

6.1 Communicating with You. We may use Your Personal Information to communicate directly with You and to respond to Your inquiries (e.g., support requests) or service-related emails (e.g., technical and security notices). This communication is necessary for Our legitimate interests, namely administering the Platform and communicating with You in relation to the Platform. 

6.2 Email Communications. We may use Your Personal Information to send You email communications, when You sign up or subscribe to receive email communication about Our products, services, special promotions, events, alerts, loyalty offerings and other news. We will only use Your Personal Information in this manner to the extent that You have given Us consent to do so and will only communicate with You in accordance with applicable anti-spam legislation. You can opt-out of receiving such email communications, by clicking the “unsubscribe” link found in all email communications. Please allow up to ten (10) days for Your “unsubscribe” request to be processed. 

6.3 Platform Optimization and Improvement. To improve the Platform and provide users with the best possible experience, We may collect and analyze certain data related to the performance and use of the Platform. We use this data only for Our legitimate business purposes. 

6.4 Administer Our loyalty program. We may use Your Personal Information to administer Our loyalty program, including to create and manage Your member account, verify Your eligibility, record Your purchases and activities to calculate and allocate points or other benefits, process redemptions and related requests, and provide You with the rewards, personalized offers, and privileges associated with the program. We may also use Your Personal Information to communicate with You about the program (e.g., points balance, status, changes to program terms, reminders, or administrative notices). Where required by law, we will obtain Your consent for these uses and will handle Your Personal Information in accordance with applicable laws. 

6.5 By using the mobile application, We may collect information about Your mobile device, including the device type, operating system and version, unique device identifiers (such as IDFA, GAID, or similar identifiers), mobile network information, and hardware model. 

6.6 With Your consent, We may collect precise geolocation data from Your mobile device. You may disable location services at any time through Your device settings. If You choose not to provide location information, certain features of the mobile application may not function properly. 

7.    Consent to the Collection of Personal Information

We use Your Personal Information only with Your meaningful legal consent, except as otherwise permitted or required by law. The consent provided for the use of Personal Information is for the specified, explicit, and legitimate purposes outlined in this Privacy Policy and/or as otherwise specified prior to Your providing consent.

BY VISITING OR USING THE PLATFORM, OR OTHERWISE COMMUNICATING WITH US, YOU AGREE TO BE BOUND BY THIS PRIVACY POLICY AND CONSENT TO THE COLLECTION, USE, RETENTION, DISCLOSURE, TRANSFER, AND DESTRUCTION OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THE TERMS DESCRIBED HEREIN. IF OTHER TERMS APPLY, WE WILL DESCRIBE THEM AT THE TIME OF COLLECTION. 

In certain cases, You may explicitly and intentionally provide Us with, and consent to, Our collection of certain Personal Information by: 

7.1 Email Requests for Information. We use links throughout Our Platform to provide You with the opportunity to contact Us via email to ask questions, request information and materials, or provide comments and suggestions. You may also be offered the opportunity to have one of Our representatives contact You personally to provide information about Our Platform. To satisfy Your request, We may request additional Personal Information from You, such as Your name, email address, and/or telephone number. 

8.    New Consent Required 

We only use your Personal Information for the purposes stated above except where we are permitted by law, in very limited circumstances, to do so without your consent. Before We collect, use, or disclose Your Personal Information for a new purpose, We will disclose the new purpose and request Your consent, unless the applicable laws allow us to do so without your consent.

9.    No Consent Provided 

Although You are not legally required to provide Personal Information, We reserve the right to withhold or deny access and use of the Platform where the appropriate Personal Information is not provided to carry out the associated purpose. 

10.    Withdrawal of Consent

You can withdraw Your consent to the collection, use, and disclosure of Your Personal Information at any time by contacting Us and informing Our Privacy Officer at privacyofficer@macewen.ca. Please note that Your withdrawal of consent may impact Our ability to provide You with the Platform. 

11.    Disclosure Without Consent 

We do not communicate, disclose or transfer Your Personal Information to third parties without Your consent, except as permitted or required by law or as necessary for the purposes outlined in this Privacy Policy. For example:

  • We may communicate Personal Information that We collect or You provide as described in this Privacy Policy to contractors, service providers, and other third parties We use to support Our business (such as marketing automation, analytics and search engine providers that assist Us with marketing communications, Platform improvement and optimization). Such third party service providers are contractually obligated to keep personal information confidential, use it only for the purposes for which We communicate it to them, and to process and safeguard the personal information with the same standards set out in this Privacy Policy. 

  • We may also communicate Personal Information in connection with a commercial transaction, including without limitation a merger, acquisition, financing, reorganization, sale of all or part of Our business or assets, or similar transaction (including related due diligence), subject to appropriate confidentiality protections and applicable law. 

  • ​In addition, We may disclose Personal Information to comply with a court order or decision (including without limitation a valid search warrant) or an order or decision of a regulatory authority, and We may, in certain circumstances, disclose Personal Information to defend or enforce Our rights. 


For Quebec residents, please note that Your Personal Information will be communicated outside Your province. 

Moreover, Your Personal Information will be processed and stored by and transferred to third party service providers located outside of Canada. In such circumstances, Your Personal Information will be subject to the legal requirements of the applicable jurisdiction, including local requirements to disclose information to its courts, law enforcement and regulatory authorities. Whenever We engage a service provider, We require that its privacy and security standards adhere to this Privacy Policy and applicable Canadian privacy legislation. 

12.    Accuracy of Collected Information 

We implement policies and procedures to ensure that the Personal Information in Our possession is accurate, complete, and up to date. You can submit updates to Your Personal Information to Our Privacy Officer at any time. Any Personal Information in Our possession that is used by trusted third parties to facilitate Our Platform will also be updated to reflect such changes. 

13.    Access to Personal Information 

An individual may request access to the Personal Information that We hold about themselves at any time. We will respond to requests for access promptly and within the legally mandated time frame subject to any refusals permitted or required by law. Any refusals to grant access will be accompanied by associated reasons and information regarding available recourse. Requests for access to Personal Information can be directed to Our Privacy Officer at privacyofficer@macewen.ca.

14.    Retention of Personal Information 

We retain Personal Information only for as long as needed to perform the purposes of collection or to comply with legal requirements. Once Personal Information is no longer required for the purpose for which it was collected, We will apply all commercially reasonable safeguards to safely and securely destroy such Personal Information. 

15.    Public Access to Our Websites 

We provide public access to information regarding Our Platform. 

15.1 Statistical Information About Your Visit. When You visit or use the Platform, We may automatically collect statistics about Your visit or use. This information does not identify You directly, but rather provides Us with information about Your use of the Platform. We may monitor statistics such as use of the mobile application, how many people visit Our websites, the user's IP address, which pages people visit, from which domains Our visitors come, and which browsers people use. We use these statistics about Your visit or use only to help Us improve the performance of the Platform. 

15.2 Use of Cookies. We may collect information about You and how You interact with Our Platform through the use of cookies and similar technologies. Cookies are small text files that are sent to Your browser and stored on Your device when You visit Our websites or use the mobile application, thereby tracking Your preferences and activities on Our Platform. For example, some cookies remember Your language or location preferences so that You do not have to repeatedly make these choices when You visit Our websites or use the mobile application. Our Platform uses cookies and similar technologies for a number of reasons, including to analyze user behaviour to establish visit patterns so that We can improve Platform functionality, to provide users with a personalized experience, to keep Our services secure, and in general to provide users with a better experience. We also use cookies to help Us with geolocation tracking in order to present You with the closest Quickie Convenience Store and office locations. These cookies may include essential cookies that are necessary for the operation of the Platform, as well as performance and analytics cookies that help Us understand how visitors interact with Our websites or how users use the mobile application. You should be aware that cookies contain no more information than You voluntarily provide, and they are not able to access Your hard drive or return to the sender any Personal Information or other information from Your computer or mobile device

You have the option to reject or block all or specific types of cookies by adjusting Your browser settings or by clicking on Our cookie preferences tool on Our websites; however, this may result in the inability to access or otherwise interfere with the functionality of Our Platform. Certain features of Our Platform may use local stored objects (or Flash cookies) to collect and store information about Your preferences and navigation to, from, and on Our websites. Flash cookies are not managed by the same browser settings that are used for browser cookies. 15.3 Third Party Use of Cookies and Other Tracking Technologies. Some content or applications on Our Platform, including advertisements, are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies or other tracking technologies to collect information about You when You use Our Platform. The information they collect may be associated with Your Personal Information or they may collect information, including personal information, about Your online activities over time and across different websites and other online services. They may use this information to provide You with interest-based (behavioural) advertising or other targeted content. You can opt-out of several third-party ad servers' and networks' cookies simultaneously by using an opt-out tool created by various self-regulatory industry associations. Opting out of a network does not mean You will no longer receive online advertising. It does mean that the network from which You opted out will no longer deliver ads tailored to Your web preferences and usage patterns. We do not control these third parties' tracking technologies or how they are used. 16.    Opting Out of Future Notifications 

From time to time, We may notify You of new products, announcements, upgrades, and updates. If You would like to opt-out of being notified, please use the provided unsubscribe mechanisms or contact Us at privacyofficer@macewen.ca.

17.    Security Procedures and Safeguards 

We consider the protection of all data and Personal Information We receive from You as critical to Our corporate mission. Please be assured that We have security measures in place to protect against the loss, misuse, and alteration of any information We receive from You in accordance with applicable law. 

17.1 Procedural Safeguards. We maintain physical, technological, and procedural safeguards in connection with the collection, disclosure, storage, use, and deletion of Personal Information. Proof of identity may be required upon request to disclose Personal Information to You. You should protect against the theft of Your Personal Information through safeguarding Your passwords and devices. 

17.2 Technological Safeguards. As with any transmission over the Internet, there is always some element of risk involved in sending Personal Information. To try to minimize this risk, Our websites use the Secure Sockets Layer (SSL) protocol and Our mobile application uses the Transport Layer Security (TLS) protocol. 

17.3 Personnel Safeguards. Our employees who have access to Personal Information receive privacy training and are required to respect the confidentiality of such information pursuant to their employment agreement with Us. Restrictions on access to Personal Information at the personnel level include restricted access to physical locations in which Personal Information is held, as well as technological protections (e.g., passwords). Disclosure and access to Personal information by personnel is limited to the extent required to reasonably fulfill the specific purposes for which it was provided. 

17.4 Governance Policies. We have adopted policies and practices to manage our governance with regards to the protection of Personal Information that include: 

  • A framework applicable to the use, communication, retention and destruction of such information;

  • The roles and responsibilities of our employees throughout its life cycle; 

  • A process for handling complaints concerning its protection. 


18.    Notification of a Security Breach 

In the event of a security breach of the above mentioned safeguards involving Personal Information in Our control that presents a real risk of significant harm, notice of the breach will be provided without undue delay to the affected individual(s).

19.    Changes to this Privacy Policy 

We reserve the right to update or modify this Privacy Policy at any time without prior notice. Any changes will be effective immediately upon posting on Our Platform. We encourage You to review this Privacy Policy periodically for updates.

All complaints We receive related to Personal Information are investigated. We will review and respond to your inquiry within the time required by applicable law. If you are not satisfied with our response, you may contact the applicable privacy authority in your jurisdiction.
